In the following terms & conditions “the photographer” shall mean Divya Patel trading as DivClick. “The clients” shall be the person, hiring DivClick for photography service. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed upon by the photographer in writing.
1. COPYRIGHT
- The copyright Designs and Patents Acts assign the copyright of the images to the photographer.
2. DISPLAY
- The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, social media post, websites, sample albums, etc.
3. COVERAGE & PRODUCTION
- Photograph quality very much depends on the event atmosphere, lights availability, effort of a person who is being clicked, etc.
- Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.
- The photographer is not responsible for any type of permission related to photography at a certain place, using locations of the venue.
- Charges of the photographer are clearly only for photography service. We are not providing any type of transportation, props, outfits, makeup artist, helper, or meal.
4. PAYMENT
- You have to pay 50% advance (of decided amount) to the photographer, as we also need to pay advance to co-persons and rental equipment.
- The client should pay a 50% pending amount to the photographer on completing the event.
- The client will get random photographs to verify the photography quality. After completing the full payment, client will get all high-quality photographs.
5. ON THE DAY
- The photographer will be the sole professional (still) photographer at the venues specified. The photographer does however positively encourage family, friends and other guests to take photographs throughout the day.
- The photographer will not click photos during the wedding breakfast/lunch/dinner and will use this time to take a break. A meal is not a requirement; however, one would be greatly appreciated.
- The photographer cannot be held responsible for any personal accidents on the client's side during a photographic shoot.
6. DELIVERY
- The photographer will be the sole professional (still) photographer at the venues specified. The photographer does however positively encourage family, friends and other guests to take photographs throughout the day.
- The photographer will not click photos during the wedding breakfast/lunch/dinner and will use this time to take a break. A meal is not a requirement; however, one would be greatly appreciated.
- The photographer cannot be held responsible for any personal accidents on the client's side during a photographic shoot.
- Final video will be provided to client which covers all the usable video clips. Raw video files will not be prvided to client.
7. CANCELLATION FEES
- i. If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation:
- Cancellation from the booking date and more than one week to go until the event, cancellation fees are 5% of the total amount.
- Cancellation with less than one week to go until the event date, cancellation fees are 10% of the total amount.
- Cancellation on the date of event, cancellation fees are 50% of the total amount.
- Cancellation from the photographer side, no cancellation charges will be charged.
