This Refund Policy ("Policy") outlines the terms and conditions governing refunds for the services provided by divclick.in, including photography, web design and development, and app design and development. By engaging our services, you ("Client") agree to comply with this Policy.

1. No Refund Policy

a. At DivClick, we are committed to delivering high-quality photography, videography, and design services with professionalism and dedication. Once a booking or service agreement is confirmed, we do not offer refunds under any circumstances, including but not limited to:

i. Change of mind by the client

ii. Event cancellation or postponement by the client

iii. Dissatisfaction with the creative style after project completion

iv. Delays or unforeseen circumstances affecting the event

b. All advance payments made towards any service are non-refundable and non-transferable. By availing of our services, the client agrees to this policy.

2. Legal Compliance Under Indian Law

a. This refund policy is in accordance with Indian Contract Act, 1872, which allows businesses to set their own refund terms. As per Indian law:

i. Once a client agrees to our terms and makes a payment, a binding contract is established.

ii. As per Section 17 of the Indian Contract Act, 1872, refunds are only applicable in cases of fraud or misrepresentation, which do not apply to creative services like photography or design.

iii. Under the Consumer Protection Act, 2019, refunds are only mandated in cases of defective goods or deficient services. Since our services are customized and non-tangible, refunds are not applicable.

3. Payment Terms & Cancellation

a. Clients must make an advance payment to confirm the booking, which is non-refundable.

b. If a client cancels the service at any stage, the amount paid will not be refunded, as our team invests time, effort, and resources from the moment of booking.

4. Exceptions

a. Refunds will only be considered if DivClick fails to provide any service at all due to internal reasons. However, factors such as artistic differences, subjective dissatisfaction, or force majeure (natural disasters, pandemics, etc.) do not qualify for a refund.

5. Dispute Resolution

a. In case of any disputes, we encourage clients to contact us for resolution. If needed, disputes will be handled as per the laws of Vadodara, Gujarat, India, and settled through mutual discussion, arbitration, or legal proceedings in the appropriate jurisdiction.
